Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TuneUp Golf ("TuneUp," "Company," "we," "us," or "our") governing your access to and use of the TuneUp Golf web application and related services (the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

TuneUp Golf provides a web-based platform that enables golf instructors to manage lesson scheduling, communicate with students, and operate their instructional business. Students may schedule, purchase, and participate in golf lessons. The Service may include integrations with third-party services to enhance functionality, including scheduling and payment processing.

You may be required to create an account to access certain features. You agree to provide accurate information and maintain the security of your account credentials. You are solely responsible for all activities that occur under your account.

You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purposes. You agree not to use the Service for unlawful purposes, interfere with its operation, or attempt unauthorized access. You are responsible for all content, communications, and transactions conducted through your account.

The Service may facilitate payments through third-party providers. TuneUp is not a payment processor and does not control or assume liability for payment transactions. All payment disputes are solely between the instructor and the student.

The Service may integrate with third-party platforms, including Google and payment providers. TuneUp is not responsible for the availability, accuracy, or practices of such third-party services. Your use of third-party services is governed by their respective terms.

TuneUp reserves the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for conduct that may harm the Service or other users. You may terminate your account at any time.

Your use of the Service is subject to our Privacy Policy. TuneUp collects and processes only the data necessary to provide the Service and does not sell personal data to third parties. Google user data is used strictly in accordance with Google API Services User Data Policy.

You agree to indemnify, defend, and hold harmless TuneUp and its affiliates from any claims, damages, or liabilities arising out of your use of the Service, your violation of these Terms, or your interaction with other users.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding arbitration conducted in Wyoming. Arbitration shall be conducted on an individual basis and not as part of a class action.

TuneUp reserves the right to modify these Terms at any time. Updated Terms will be posted with a revised effective date. Continued use of the Service constitutes acceptance of the updated Terms.

These Terms constitute the entire agreement between you and TuneUp regarding the Service and supersede all prior agreements.
